Why we collect personal information

We collect personal information so that we can:

  • accept and process your application for a loan in accordance with the requirements by law;
  • assess your personal and/or commercial creditworthiness;
  • make a determination about the risk of you defaulting on your obligations to us;
  • undertake, where appropriate, risk assessment and management involving securitisation, credit scoring, portfolio analysis, reporting and fraud prevention and claim recovery;
  • if your application is successful, provide you with a loan and determine on what terms we will do so;
  • manage your account with us;
  • assist in the resolution of any dispute you have with us;
  • provide you with information about other products or services we currently offer, or may offer in the future or are offered by our commercial partners, and
  • satisfy an obligation we may have under the law to collect personal information or make assessments.

We will not use personal information we have collected for a purpose other than that disclosed in this Privacy Policy without your consent, or in circumstances where you would reasonably expect the use for that purpose.


If you do not provide us with your personal information

If you do not provide us with your personal information or give us consent to collect it from others, we will be unable to, amongst other things, process your application and make the assessment that we are required to by law. We will therefore not be able to satisfy our obligations and will not be able to give you a loan.

Where do we get personal information form?

We obtain personal information from any of the following sources:-

  • you in the process of your loan application or in other communication with you;
  • publicly available information such as telephone directories, information on websites or from public databases such as the electoral roll;
  • other credit providers from whom we request information;
  • credit reporting bodies;
  • persons or entities you have authorised to provide us with information;
  • your use of our website with the aid of "cookies", and
  • marketing companies from which we may acquire information in order that we may offer services to you.

Where we obtain personal information which we are either required to collect, or authorised to collect by law, we will advise you of that


Sensitive information

"Sensitive information" is information about your racial or ethnic origin, political opinions, membership of a political association, religious beliefs or affiliations, philosophical beliefs, membership of a professional or trade association or trade union, sexual preferences or practices, criminal record, health or genetic information.
We will not collect, use or disclose any sensitive information about you unless we have your specific consent, and it is necessary to undertake one of the functions referred to above.

Exchange of personal information

We may disclose your personal information to:-

  • such credit reporting bodies, ratings agencies and any business which provide information about the credit worthiness of persons with whom we have a commercial arrangement (more detail about this appears below);

  • personal and/or business referees nominated by you, including your employer (in relation to your employment status and income);
  • our professional advisers, contractors and other service providers (eg. IT consultants);
  • your legal and financial advisers (if any) if permitted by you;
  • Centrelink, Australian Taxation Office or other Government departments, agencies or bodies, to whom we may be required by law to disclose information supplied by you to us;
  • our financiers;
  • our contractors, agents and service providers (including debt collectors) in order that we may deal with you more efficiently or collect monies owing to us;
  • our ASIC and OAIC approved external dispute resolution service;
  • payment system operators (if any);
  • our insurers, insurance underwriters/providers in relation to our insurance policies;
  • entities who may purchase (or who may be interested in purchasing) any interest in the obligations you may owe us under the credit contract, and

entities (either credit licensees (credit providers or credit assistance providers) or lead providers) to whom we may sell your personal information for a fee. The credit licensees or lead providers may either provide a service to you themselves or on-sell your personal information to others on the same basis as your personal information is sold to them.

Credit Reporting

The Privacy Act allows credit providers to disclose some information to credit reporting bodies. The information which is disclosed depends on the level at which we participate in the credit reporting system. The credit reporting bodies are also bound by the Privacy Act and are restricted in the uses to which that information may be used. Each of the credit reporting bodies must have a policy, similar to this one, to explain how it uses your information.
The information we may disclose to a credit reporting body is the following:-

  • whether we provide you with a loan;
  • the type of loan provided;
  • the amount of the loan provided;
  • the date the loan was supplied;
  • the date the loan terminated;
  • the terms of the loan;
  • whether payments are made on the loan;
  • if you default in making a payment on the loan (where the amount is $150 or more and has been outstanding for 60 days or more);
  • whether you were late in making payments and whether you make those payments up, and
  • if you commit a serious credit infringement (fraudulent activity or deliberately evading your obligations under the loan terms).

The Privacy Act provides that, subject to some exceptions, you have a right to know what information we hold about you including information we have obtained from a credit reporting bodies. If you wish to access the personal information we hold about you, including information we have obtained from a credit reporting body, you should make contact with us in any of the following ways:-

We will usually be able to provide this information to you within 30 days of the request. Should we require longer, we will write to you advising you a reason and seeking additional time. We may require you to pay our reasonable costs of providing this information to you. There are restrictions in relation to those costs contained in the law.
If possible, we will provide you with the personal information in the form you request. However, in some circumstances it may be necessary for you to access that information in a method determined by us, but we will always make it as easy as possible for you to access that information.
There may be occasions where we cannot provide you with that information. In such a case we will write to you and give you our reasons.


You can request that any personal information we hold be corrected if it is inaccurate, incomplete or out of date. If you wish to make such a request you should contact us by any of the methods set out above.
If your request relates to information that we have received from a credit reporting body, we will contact the credit reporting body and advise them of your request.
If we agree with you that your information is inaccurate, incomplete or out of date we will make the appropriate changes and will write to you and tell you the changes we have made within seven days of making that change.

If we do not agree that the information is inaccurate, incomplete or out of date, we will write to you giving you the reasons why we have formed the opinion and tell you what steps you can take as a result of our refusal to change the information.


You are entitled to complain if you believe we have not dealt with your personal information in accordance with the provisions of the Privacy Act (including the 13 Australian Privacy Principles) or any code under the Privacy Act (including the Credit Reporting Privacy Code).
If you wish to make a complaint, you should first contact us telling us what the complaint is and we will do our best to resolve the complaint with you.
If we believe that we cannot resolve the complaint within 30 days, we will write to you telling you why and seeking further time.
If you are not satisfied with the resolution of the complaint, you have a right to refer the complaint to our external dispute resolution service, the Credit Ombudsman Service Ltd ("COSL") or to the office of the Australian information Commissioner ("OAIC").

We have a written policy ("Dispute Resolution Policy") in place under which we deal with any complaint made under the provisions of the National Consumer Credit Protection Act. Information collection

To provide a better customer service we collect all information that you choose to disclose through internet, fax, telephone, emails and mail that is non-public.  Financier may disclose personal and non-public information to third-parties such as collection agencies, which does not include publicly available information such as electoral rolls, phone directories or government sources.

Information that we obtain by following up and verifying information  and representations provided by you through your application forms, your related transactions with affiliated and non-affiliated third parties, from consumer reporting agencies, your current employment and employment history and your account information.

Your IP address and host name

Financier websites log Host Names (or IP addresses when the Host Name is not available) for systems administration and security purposes. These logs are monitored and analysed to maintain systems and information security and allow us to constantly improve the value and the availability of the web content. We encourage all visitors to register with Financier for enquiries about our products and for free assessments. The registration forms require users to give us accurate contact information (i.e. name and email address) and references that help us better serve you. Your name and email address may be used to send you information about our company, product updates, special offers, and newsletters if you opt to receive them. Simply contact Financier to opt out of receiving communications if required.

Email Handling

All emails that are used in correspondence to and from you are recorded and stored within our confidential data base together with relevant company information.

Information Transfer Security

SSL is an abbreviation for Secure Socket Layer and scrambles your information as it is en route to us, then when it arrives it is decoded.  When you apply through our site your data is secured by SSL.  However, it is not recommended that when you use your own email or Messenger services for the transmission of sensitive communications such as drivers’ licences, bank account numbers or other similar information that you either use our site with SSL protection or phone our office.

Persons under the age of eighteen are prohibited from using the services of Financier Pty Ltd.  Inappropriate content on websites may be screened by parents purchasing available software programmes to prevent their children from viewing and using such content.

Confidentiality of Employees

Financier take great care to safeguard confidential and sensitive data, transactions and processes at all times, reflected in limited employee access, restriction to only trained and authorised personnel, identification and marking of confidential information.

We may disclose information when legally compelled to do so as required by law, or for protection of our legal rights.

Requests for deletion of information

When a person has received a loan with Financier Pty Ltd, his/her information cannot be deleted due to Federal regulations and company policies. All customer information will be kept for a minimum of 7 (seven) years. Financier Pty Ltd stores all information received in the form of data, fax and photocopy documents, voicemail, email, instant messages according to our stated policies, and purges them at our discretion. We keep email records as per our company and regulatory requirements.


If you have not applied for a loan, you are entitled to request in writing either by email, fax or letter that we delete your personal information.  Approved, pending and denied loans will be kept at our discretion until purged.  According to Federal regulations and our company policy all information regarding loans cannot be deleted and will be kept for a minimum of two years.


Our websites provide users with the opportunity to opt-out of receiving communications from us at the point where we request information about the visitor. Please note that opting-out of all communications will suppress every piece of electronic information from Financier and is not restricted to only the communications listed on the subscription page.

Bank Vision

Why do you ask for my internet-banking details?


By inputting your details we are able to view [90] days of bank account history. This helps us make our lending decisions, assessing whether and if so what amount of credit is affordable and sustainable for you.  As a responsible lender, we work with credit reference agencies to review your creditworthiness. As part of that process it is important for us to verify your incomings and outgoings. Ultimately, this will help us ensure that you do not fall in difficulties in making the repayments due under a loan or incurring further costs and charges. We are only permitted a read-only access to your current account, so will only ever be able to view the recent transactions on your account – nothing more. Your bank details are encrypted in transit and stored securely by Yodlee. We do not have the ability to change any of your banking details, set up standing orders/direct debits or to manage your account in any other way. All data is securely handled in accordance with data protection laws and our privacy policy.


Who sees my internet banking log-in details?


No person can access your internet banking details. When you enter your banking credentials on our website they are immediately encrypted. The encrypted details are then passed by Perfect Data Solutions Limited to Yodlee. They are stored in a highly secure data centre which has a single use, which is to generate a read-only data-feed which we will use to assess the affordability of the loan.


What happens to my internet banking details after input them on your website?


As an organisation, security of data and prevention of fraud are fundamental to us. We are committed to using practices to ensure that our services are provided within a secure environment. Your internet banking details are encrypted and held securely by our professional service providers and are encrypted. Our partner, Perfect Data Solutions Limited, Yodlee and us, are permitted read-only access to your current account, so will only ever be able to view your account. We do not have the ability to change any of your banking details or set up standing orders/direct debits. All data is securely handled in accordance with data protection laws and our privacy policy.


What happens to the bank statements you obtain?


They will be used by use to make lending decisions about you and stored by us as long as necessary to assist us in managing your account or underwriting loan to you.  It will be stored by Perfect Data Solutions Limited and Yodlee.


What will my bank say about me inputting my log-in details into your website? 


We would recommend that you review the Terms and Conditions of your internet banking provider. Before you decide to submit your baking credentials, we would stress that security is of paramount importance, we would especially mention that:
